1. Scope
These terms govern use of the TOBIRA STUDIO website, prompt library, accounts and related features (the "Service") provided by TOBIRA STUDIO (sole proprietor: Kensei Yasue) ("we", "us").
By using the Service you are deemed to have accepted these terms. For pricing, auto-renewal, cancellation and refunds, see the Pricing, auto-renewal, cancellation & refund policy also forms part of these terms.
2. Accounts
- Keep your registration details accurate and up to date.
- You must not share, lend or transfer your login credentials to anyone else.
- Minors may use the Service only with the consent of a legal guardian.
- If you become aware of misuse, please tell us promptly at Contact.
3. Pricing plans
Annual plan (TOBIRA RESIDENCY)
Once sales open, ¥50,000 per year (tax included) gives access to every Premium prompt now and in future. The term is one year and renews annually unless cancelled.
Lifetime plan (TOBIRA ESTATE)
Once sales open, a single payment of ¥100,000 (tax included) gives access to every Premium prompt now and in future, with no further recurring charges.
"Lifetime" means access for as long as the Service continues to be offered. It does not mean the buyer’s lifetime. If we discontinue the Service we will give reasonable advance notice so far as practicable.
For prices and full conditions, see the pricing page and Pricing, auto-renewal, cancellation & refund policy for details.
4. Prompt licence
While your access is valid, you may use the prompts you have obtained in your own or your clients’ websites, applications, documents and other work. Both personal and commercial use are permitted.
The licence is non-exclusive and transfers no copyright or ownership in the prompts themselves. Before publishing anything you generate, check its quality, safety, licensing and third-party rights yourself.
5. Prohibited conduct
The following are prohibited.
- Redistributing, selling, lending, publishing or sub-licensing all or a substantial part of the prompt text or the library
- Using the Service to build a competing prompt library, dataset or search service
- Circumventing access controls, sharing credentials, automated scraping or excessive machine retrieval
- Anything unlawful, contrary to public order and morals, or infringing the intellectual property, privacy or other rights of third parties
- Interfering with the operation or security of the Service, or with other users
6. Intellectual property and third-party notices
Rights in the structure, text, prompts, design, trade marks and related materials of the Service belong to us or to their rightful owners.
Where a work’s name or description mentions a third-party brand, product or design system, that implies no partnership, endorsement or official relationship with them. Before publishing or selling what you generate, it is your responsibility to confirm that it does not infringe third-party trade marks, copyright or other rights.
For rights infringement notices, write to info@tobira.studio.
7. Changes and suspension of the service
We may add to, change or suspend the Service for reasons of quality, legal compliance, safety or operational necessity. Where the effect on users is significant we will give prior notice by reasonable means, though urgent security responses may leave no room for it.
"Prompts added in future" means those we offer as Premium on the Service. We do not guarantee any particular number of works, update frequency, or that any individual work remains published.
8. Warranties and liability
We do not warrant that the Service or its outputs are fit for any particular purpose, entirely accurate, or free from interruption or defect. You are responsible for reviewing the outputs and for how you use them.
To the extent the law allows our liability to be limited, our total liability in damages is capped at the amount you actually paid us in the twelve months before the event giving rise to the claim. This cap does not apply to our wilful misconduct or gross negligence, or to any liability that cannot be limited by law.
9. Suspension and termination
If you materially breach these terms, or we confirm fraudulent payment or unauthorised access, we may suspend access without prior notice, require the problem to be put right, or terminate the contract. So far as the law allows, no refund is given for a termination caused by a breach.
10. Changes to these terms; governing law
We may amend these terms where there is a change in law, a change to the Service or other reasonable need. Material changes will be announced on the Service or by email to your registered address, stating the date they take effect.
These terms are governed by Japanese law. For any dispute concerning the Service or these terms, the Tokyo District Court has exclusive jurisdiction in the first instance.
For questions about these terms, write to contact pageorinfo@tobira.studio.
